ANNOUNCEMENTS:

  1. COMMUNICATION FROM THE PRESIDENT:

I. Transmission of the National Minimum Wage Bill 2024 for consideration and passage by the House of Representatives. He anticipates and appreciates the normal cooperation of the House of Representatives on such matters.

II. Transmission of Nigeria Police Act Amendment Bill 2024 for consideration and passage by the House of Representatives. He anticipates and appreciates the normal cooperation of the House of Representatives on such matters.

  1. DEFECTION OF HONOURABLE MEMBER:

I. Hon. Idris Salman, defected from the Africa Democratic Congress (ADC) to the All Progressives Congress (APC) vide a letter read on the floor by the presiding Speaker, Abbas Tajudeen.

  1. There will be a meeting of Honourable Members of the APC caucus immediately after plenary at the temporary chamber of the House of Representatives (Hearing Room 028)

PETITIONS:

  1. Hon. Jesse Onuakalusi laid a petition on behalf of a complainant against Nigeria AGIP Oil Company on the alleged refusal to pay over 3 Million Dollars owed after the execution of a contract.
  2. Hon. Dominic Ifeanyi laid a petition on behalf of a complainant against a Real Estate agent on alleged breach of contract.
  3. Hon. Yusuf Takai laid a petition on behalf of a complainant against the Nigeria Police on alleged wrongful dismissal from the service.
  4. Hon. Usman Murtala laid a petition on behalf of a complainant against the Nigeria Drug Law Enforcement Agency on alleged unlawful treatment.
  5. Hon. Joseph Edionwele laid a petition on behalf of a complainant on the alleged kidnap of her son. She is calling on the Inspector General of Police to cause an investigation into the matter and ensure his release.
  6. Hon. Ikenga UgoChinyere laid a petition on behalf of a complainant against an organization for allegedly owing money for services rendered.
  7. A petition was laid against the Nigeria Police on alleged maltreatment.
  8. Hon. Nnamdi Ezechi laid a petition on behalf of a complainant against the Federal Polytechnic in Imo state and its governing council on alleged illegalities in its affairs.

All petitions were referred to the House Committee on Public Petitions.


MATTERS OF URGENT PUBLIC IMPORTANCE:

  1. Hon. Iyawe Esosa moved a motion on the need to address the problems in the petroleum sector and it was seconded by Hon. Tajudeen Kareem. Hon. Iyawe in leading the debate stressed the urgent need for the House to ensure sanity in the oil sector as it remains the lifeline of the Nigerian economy and chief revenue earner for the Federal Government and the Nigerian people. He expressed worry over the manner that the irregularities seem to be frustrating the smooth takeoff and running of the Dangote refinery which people were looking up to as a good support for the national refineries when they come on stream. Hon. Iyawe called on the relevant Committees of the House on Petroleum Resources to ensure they engage the relevant government agencies with a view to ending all abnormalities in the sector.

Hon. Mark Esset proposed an amendment calling on the House to refer the motion to the House Committee on Petroleum Resources (Midstream and Downstream). The motion was voted on, adopted and referred to the House Committee on Petroleum Resources (Midstream and Downstream).

  1. Hon. Zakaria Nyampa moved a motion on the need to address the effects of the ravaging flood in communities in Adamawa state and it was seconded by Hon. Fatoba Gbadura. Hon. Zakaria in leading the debate stated that the flooding has completely ravaged the affected communities and called on the National Emergency Management Agency, the Northeast Development Commission, as well as the Ministry of Humanitarian Affairs to come to the aid of the victims and provide aid assistance to alleviate their suffering. The motion was voted on, adopted and referred to the House Committee on National Emergency Management Agency.
  2. Hon. Patrick Umoh moved a motion on the need for the House to ensure the Nursing and Midwifery Council of Nigeria abides by the resolution of the House and it was seconded by Hon. Muktar Shagaya. Hon. Umoh in leading the debate stressed the need to ensure the Council abides by the resolution of the House to the latter, regarding its registration exercise.

He stated that instead of abiding by the resolution of the House to show transparency in the exercise, the Council shutdown the site of the registration and made it look like it was directed by the House of Representatives to do so, putting the House in bad light with the public. He called on the Council to ensure it reopens the site and continue the registration process in a transparent manner devoid of bias. The motion was voted on, adopted and referred to the House Committee on Health Institutions.

  1. Hon. Rodney Ebikebina moved a motion on the need to contain the oil spillage in coastal communities in Bayelsa state and it was seconded by Hon. Umar Ajilo. Hon. Rodney in leading the debate stressed the need for the National Oil Spillage Detection Agency to detect the cause of the oil spillage to stop the damage being caused by the spillage. He stated that if not checked, the spillage will continue to harm water supply, agriculture, livestock and fishing activities in the region. Hon. Rodney called for decisive steps to be taken to protect the lives and livelihoods of those in the communities. He called on the House Committees on Environment and Petroleum Resources (Upstream) to investigate the issue.

He further called on the National Emergency Management Agency to provide aid to the affected communities. Hon. Rodney further called on the Nigeria AGIP company to cleanup the spillage caused by its activities. The motion was voted on, adopted and referred to the House Committee on Environment, Petroleum Resources (Upstream) as well as that on NEMA.

  1. Hon. Agbedi Frederick moved a motion on the need to address the havoc caused by a fire at a market in Abuja Municipal Council and it was seconded by Hon. Gaza Gbwefwi. Hon. Agbedi in leading the debate stated that the fire outbreak ravaged the market resulting in the destruction of goods and services worth millions of Naira. He stated that the market used to serve a large area of communities in the Abuja municipal area, hence the urgent need to ensure it is brought back to complete functionality. Hon. Agbedi called on the National Emergency Management Agency to provide assistance to the affected victims and that Honourable Members should contribute funds to the rehabilitation.

Hon. Ali Isa proposed an amendment to delete prayer 3, as the money contributed by Members was for providing food palliatives for Nigerians and cannot be channeled to this problem. The motion was voted on, adopted as amended and referred to the House Committee on FCT Area Council as well as that on NEMA.

Debate:
Hon. Julius Ihonbvere moved for the third reading of the Bill and it was seconded by Hon. Ali Isa. The Bill was voted on, read for the third time and passed.

Hon. Francis Waive moved for the House to suspend its relevant rules to allow it commence and conclude debate on Bill 2 and it was seconded by Hon. Adegboyega Adefarati.

  1. A Bill for an Act to Amend the National Minimum Wage Act, No. 8 of 2019 to increase the National Minimum Wage and reduce the time for periodic review of the National Minimum Wage from five to three years and for Related Matters (HB. 1677) (Hon. Julius Ihonvbere) – Second Reading.

Debate:
Hon. Julius Ihonbvere moved for the second reading of the Bill and it was seconded by Hon. Ali Isa. Hon. Julius in leading the debate stated that the Bill is in response to the Federal Government’s resolve to give the Nigerian worker a true living wage aimed at easing the economic hardship of Nigerians. The Bill also seeks to amend the review period from 5 to 3 years to accommodate likely fluctuations in cost of living. Hon. Julius called on Members to support it.

Hon. Ali Isa also supported the Bill as it is sensitive to the cry of Nigerians. He urged the Federal Government to continue yielding to the wishes of the people it governs. The Bill was voted on, approved for second reading and referred to the Committee of the Whole.

Hon. Francis Waive moved for the House to suspend its relevant rules to allow it commence and conclude debate on Bill 3 and it was seconded by Hon. Alhassan Ado-Doguwa.

    (i) The Accountant-General of the Federation shall, when authorised to do so by Warrants signed by the Minister charged with responsibility for finance, pay out of the Consolidated Revenue Fund of the Federation during the year ending on the 31st day of December 2024, the sums specified by the warrants, not exceeding in the aggregate N35,055,536,770,218 (Thirty-Five Trillion, Fifty-Five Billion, Five Hundred and Thirty-Six Million, Seven Hundred and Seventy Thousand, Two Hundred and Eighteen Naira) only, for the year ending on the 31st day of December, 2024.
    First Schedule.
    (ii) The amount mentioned in subsection (1) of this section shall be appropriated to heads of expenditure as set out in the Schedule to this Act.

(iii) No part of the amount aforesaid shall be released from the Consolidated Revenue Fund of the Federation after the end of the year mentioned in subsection (1) of this section.

  1. Release of funds from the Consolidated Revenue Fund
    All amounts appropriated under this Act shall be released from the Consolidated Revenue Fund of the Federation only for the purpose specified in the Schedule to this Act.
  2. Virement
    In the event that the implementation of any of the projects intended to be undertaken under this Act cannot be completed without virement, such virement shall only be effected with the prior approval of the National Assembly.
  3. Corrigendum:
    Any error in the schedule to this Act that may hinder the implementation of projects and programmes in Ministries, Departments and Agencies may be corrected through a corrigendum issued by the National Assembly: in any of the following circumstances:
    (a) If the total sum of the project or program is not affected;
    (b) Where the projects or programs are domiciled in Ministries, Departments and Agencies that lack jurisdiction to execute such projects;
    (c) Where the execution of projects or programs by Ministries, Departments and Agencies are overtaken by event; and
    (d) Where projects are wrongly costed, sited or posted to Ministries, Departments or Agencies.
  4. Excess Revenue:
    (i) The Accountant-General of the Federation shall immediately upon the coming into force of this Bill maintain a separate record for the documentation of Revenue accruing to the Consolidated Revenue Fund in excess of oil price benchmark adopted in this Budget
    (ii) Such revenues as specified in Sub-section (1) of this section refers to Revenues accruing from sales of government crude oil in excess of the approved benchmark price per barrel, the Petroleum Profit Tax and Royalty on Oil and Gas.
  5. Authorization:
    (i) No funds shall be paid out of the monies arising from the record specified in Section 5 (1) except by an Act/approval of the National Assembly.
    (ii) The Accountant-General of the Federation shall forward to the National Assembly full details of funds released to the government Agencies immediately such funds are released.
  6. Information on Funds Releases:
    The Minister of Finance shall ensure that funds appropriated under this Act are released to the appropriate agencies and or organs of government as and when due, provided that no funds for any quarter of the fiscal year shall be deferred without prior waiver from the National Assembly.
  7. Due Process Certification:
    The department of government charged with the responsibility of certifying that due processes have been complied with in the processing of implementation of projects shall ensure that all processes of approval are completed within the specified period as provided for in the Public Procurement Act.
  8. Information on internally generated revenue, domestic and foreign assistance:
    All Accounting Officers of Ministries, Parastatals and Departments of Government who control heads of expenditures shall upon the coming into effect of this Bill furnish the National Assembly on quarterly basis with detailed information on-
    (a) the Internally Generated Revenue of the agency in any form; and
    (b) all foreign and domestic assistance received from any agency, person or organisation in any form.
  9. Power of Nigerian Embassies and Missions:
    The Missions and Embassies shall constitute their Tender Board as in a Parastatal’s Tenders Board (PTB) within the requisite threshold in compliance with the extant Executive Circular and the Provisions of the Public Procurement Act.
  10. Detailed estimate:
    The detailed estimates of expenditure are set out in the Second Schedule to this Bill.
  11. Expiry Constitution, 1999:
    In line with the provisions of section 318 of the Constitution of the Federal Republic of Nigeria, this Bill expires after 12 months, starting from 1st day of January to 31st day of December, 2024 when assented to.

Hon. Abubakar Bichi stated that the report is the result of rigorous work done by the House Committee on Appropriations as a result of the request from President Bola Ahmed Tinubu. He stated that the Bill seeks to accommodate financial implications of the new minimum wage and ensure provision for critical capital and infrastructural projects to be executed by government. He urged Honorable Members to support the approval of the report.

Synopsis of the report:
Hon. James Faleke stated that the Bill seeks to amend the Windfall levy in order to control the exchange rate and pockets of some banks in order for them to meet up financially. He stated that the fluctuation of the forex market posed some initial difficulties but the Central Bank was able to intervene. Hon. Faleke stated that the House Committee on Finance worked with its Senate counterpart to come up with the harmonized report and urged Honorable Members to support it.
